Quick answer

Cannabis laws vary significantly across Europe. As of 2026, Germany has the continent's most progressive framework, permitting adult possession, home cultivation, and non-profit social clubs. The Netherlands tolerates retail sales at licensed coffee shops. Portugal has decriminalised all personal drug use since 2001. Spain allows private use and non-profit social clubs. Malta and Luxembourg permit home cultivation. Most other European countries — including the UK, France, Italy, and Poland — permit medical cannabis on prescription but maintain restrictions on recreational use.

Is Cannabis Legal in Germany?

Recreational: Legal Medical: Legal

Yes — cannabis is legal for adults in Germany. The Cannabisgesetz (Cannabis Act) came into force on 1 April 2024, making Germany the largest country in the world to legalise adult recreational use. Germany is now the most commercially significant cannabis market in Europe, with its regulatory framework closely watched by policymakers across the continent.

What is legal

Adults aged 18 and over can possess up to 25g in public and store up to 50g at home. Home cultivation of up to 3 plants is permitted. Adults can join licensed non-profit cannabis social clubs (Anbauvereinigungen), which are authorised to cultivate and distribute cannabis to members. Federal Ministry of Health guidance

Medical cannabis

Medical cannabis has been available on prescription in Germany since 2017. In 2024 it was reclassified from a narcotic to a regular prescription medicine, significantly reducing prescribing complexity. Germany imports significant quantities from the Netherlands, Portugal, Denmark, and Canada to meet demand, with imports rising 19% in Q3 2025 driven largely by digital prescribing platforms.

2026 update: Germany's Bundesrat is reviewing proposals to restrict telemedicine-issued cannabis prescriptions and mail-order dispensing. If passed, digital prescribing platforms could face significant operational changes — one of the defining policy battles for the European market in 2026.
What remains illegal

Commercial retail sales are not yet permitted under the first phase of the Cannabis Act. Consumption near schools, playgrounds, and pedestrian zones is prohibited. Possession above 25g in public remains an offence. Driving under the influence carries strict penalties.

Is Cannabis Legal in the UK?

Recreational: Illegal (Class B) Medical: Legal

Recreational cannabis is illegal in the United Kingdom and classified as a Class B controlled substance under the Misuse of Drugs Act 1971. Possession carries a penalty of up to five years' imprisonment; supply and production can result in up to 14 years.

Medical cannabis

Medical cannabis was legalised in the UK in November 2018. Despite initial access challenges, the UK has developed one of Europe's fastest-growing medical cannabis sectors. Prescription volumes increased by 130% between 2022/23 and 2023/24, with the patient population projected to reach 80,000 by end of 2025. The UK market is valued at approximately €270 million. MHRA CBMPs guidance

Medical cannabis (CBMPs) is prescribed by specialist clinicians through private clinics. Products include CBD-dominant preparations, balanced formulations, and THC-containing flower and oral solutions.

2026 update: No legislative change to recreational cannabis status is expected in the current UK parliamentary term. The Labour government has signalled no appetite for reform. The medical cannabis market, however, continues to grow and remains one of the most commercially significant in Europe.
CBD and hemp in the UK

CBD products are legal if they contain no more than 1mg of controlled cannabinoids per product. Novel food authorisation is required for ingestible CBD products, and the Food Standards Agency (FSA) maintains a list of authorised products.

Is Cannabis Legal in France?

Recreational: Illegal Medical: Legal from April 2026

Recreational cannabis is illegal in France. Possession was made subject to a flat-rate civil fine of €200 from 2020, replacing automatic criminal prosecution for minor personal use in practice — but recreational cannabis remains a criminal offence under French law.

Medical cannabis — permanent framework from April 2026

France completed a five-year medical cannabis pilot and transitioned to a permanent medical framework on 1 April 2026 — one of the most consequential regulatory moments in European cannabis history. The framework is pharmaceutical in character, built around standardised preparations, specialist prescribers, and hospital pharmacy distribution channels. ANSM guidance

France's domestic cultivation capacity is still developing toward GMP certification, with full domestic production coverage expected closer to 2028. This creates a significant two-to-three year import window in which international suppliers — particularly certified producers in Canada, Denmark, and Portugal — are well-positioned.

2026 update: France's medical cannabis market is projected to grow from €9.6 million in 2026 to €806 million by 2035 (Prohibition Partners). Reimbursement policy — whether patient access is covered by social security — is the single most consequential variable for how quickly the market scales.

Is Cannabis Legal in the Netherlands?

Recreational: Tolerated Medical: Legal

The Netherlands operates a long-standing toleration policy (gedoogbeleid) for cannabis. Retail sales are permitted at approximately 570 licensed coffee shops across the country. Adults may purchase and possess up to 5g. Cannabis remains technically illegal under Dutch law, but possession of personal amounts at licensed venues is not prosecuted. Dutch government policy overview

The supply paradox

The Netherlands has long suffered from the 'back-door problem': coffee shops can legally sell cannabis but cannot legally acquire bulk supply. A regulated cultivation pilot is underway across a limited number of municipalities — the first step toward a coherent regulated supply chain that could resolve this structural contradiction.

Medical cannabis

Medical cannabis has been available through Dutch pharmacies since 2003 via the Bureau for Medicinal Cannabis (BMC). Products are prescribed by physicians and dispensed through pharmacists, with a range of standardised preparations available.

Is Cannabis Legal in Spain?

Recreational: Grey area Medical: Legal (2025)

Cannabis occupies a distinctive legal grey area in Spain. Personal consumption and private cultivation are not criminalised under Spanish law, creating the basis for the cannabis social club model that has flourished in cities including Barcelona, Madrid, and Bilbao. Public consumption and commercial retail sales remain illegal and carry sanctions.

Cannabis social clubs

Spanish cannabis social clubs are member-only, non-profit associations that collectively cultivate and distribute cannabis for personal use among members. They operate in a grey area rather than explicit legal authorisation — permits and regulatory approaches vary significantly by autonomous region, with Catalonia and the Basque Country having the most established frameworks.

Medical cannabis

Spain launched a regulated medical cannabis framework through Real Decreto 903/2025, establishing a system centred on standardised preparations, specialist prescribers, and hospital pharmacy channels. Whether this hospital-led model can deliver meaningful patient access — or whether narrow prescribing restrictions limit the market — is the central question for Spanish cannabis in 2026. Is Cannabis Legal in Italy?

Recreational: Illegal Medical: Legal

Recreational cannabis is illegal in Italy. Possession of small amounts for personal use is treated as a civil offence subject to administrative sanctions — including possible driving licence or passport suspension — rather than automatic criminal prosecution. Supply and possession of larger quantities carry criminal penalties.

Italy's political environment has become increasingly restrictive toward cannabis reform. The Meloni government has been advancing legislation to restrict cannabis light (low-THC industrial hemp) products, which had been widely sold across retail channels.

Medical cannabis

Medical cannabis has been legal in Italy since 2007, with domestic production managed by the Military Chemical Pharmaceutical Plant (SCFM) in Florence. Domestic supply falls well short of demand, requiring substantial imports — primarily from the Netherlands and Germany. Italian Ministry of Health guidance

2026 update: Parliamentary legislation to restrict cannabis light products remains under active consideration. The regulatory environment for hemp-derived CBD and low-THC products is uncertain, with implications for both domestic retailers and international producers.

Is Cannabis Legal in the Czech Republic?

Recreational: Decriminalised Medical: Legal

The Czech Republic has one of the most progressive cannabis frameworks in Central Europe. Personal possession of up to 10g is decriminalised, resulting in a civil fine rather than criminal prosecution. Cultivation of up to 5 plants for personal use has historically been treated with similar pragmatism.

Legalisation under development

The Czech government is advancing a legalisation framework that would establish a regulated adult-use market — the first in Central Europe. Legislation is progressing through parliament, with implementation anticipated in stages from 2026–2027.

Medical cannabis

Medical cannabis became available on prescription in the Czech Republic in 2013. The framework has expanded over time, and the Czech Republic is an increasingly active market for international medical cannabis producers as prescribing volumes grow.

2026 update: Czech legalisation legislation is advancing, with the potential to create the EU's second regulated adult-use market alongside Germany — making the Czech Republic one of the most commercially interesting markets to watch in Europe right now.

Is Cannabis Legal in Switzerland?

Recreational: Pilot programme Medical: Legal

Switzerland is conducting regulated scientific pilot trials for adult recreational cannabis use in multiple cities, including Basel, Bern, Geneva, and Zurich. These trials — authorised under a special federal dispensation — allow selected participants to purchase regulated cannabis from licensed outlets, generating evidence to inform a future national framework. Swiss Federal Office of Public Health

Outside the pilots, possession of up to 10g is decriminalised and subject only to a civil fine. Switzerland has opened a public consultation on broader legalisation, signalling that national reform is a serious political question.

Medical cannabis

Medical cannabis has been legal on prescription in Switzerland since 2022, following removal of the requirement for an exceptional licence. The Swiss medical cannabis market is growing, with several licensed domestic and international producers active in supply.

2026 update: Switzerland's federal consultation on cannabis legalisation is underway. The outcome will determine whether the city pilot models expand into a national framework — a key decision expected in 2026–2027.

Is Cannabis Legal in Portugal?

Recreational: Decriminalised Medical: Legal

Portugal decriminalised personal possession of all drugs — including cannabis — in 2001, a landmark reform studied and referenced by policymakers globally. Possession of a personal supply (up to a ten-day supply, approximately 25g for cannabis) is treated as an administrative rather than criminal matter, referred to dissuasion commissions rather than courts. SICAD — Portuguese drug policy authority

Production and commercial supply remain illegal. Portugal has not legalised recreational cannabis sales, but personal use carries no criminal consequence.

Medical cannabis and cultivation exports

Medical cannabis was legalised in Portugal in 2018, and the country has become a significant EU-GMP certified cultivation hub for the European medical cannabis supply chain. Portuguese producers export to Germany, the UK, France, and across the continent — a position strengthened by France's permanent medical programme launching in April 2026.

Is Cannabis Legal in Austria?

Recreational: Illegal Medical: Limited

Cannabis is illegal in Austria. Austria's enforcement approach has a health-oriented element: possession for personal use can be treated as a health matter, with referral to treatment available as an alternative to prosecution. Supply and production carry criminal penalties under the Narcotic Substances Act.

Austria has generally been one of the more conservative European nations on cannabis policy, with limited political appetite for reform. The regulatory framework remains restrictive compared to neighbouring Germany and Switzerland.

2026 update: Austria's cannabis policies face increasing pressure to modernise, particularly following Germany's 2024 legalisation on Austria's northern border. Policymakers are navigating cross-border dynamics created by a regulated German market — where Austrian residents can legally access cannabis — alongside a domestic prohibition.

Is Cannabis Legal in Belgium?

Recreational: Decriminalised Medical: Limited

Belgium decriminalised personal cannabis possession in 2003. Adults may possess up to 3g and cultivate one plant without facing criminal prosecution, instead receiving a police warning or administrative sanction for a first offence. Larger amounts and supply activities remain criminal offences.

Belgium has not established a comprehensive medical cannabis programme comparable to Germany, France, or the UK. Some pharmaceutical cannabis preparations are available through limited specialist prescription pathways, but access is narrow.

Belgium's position at the heart of EU institutions makes it an important country to watch for EU-level cannabis policy developments, including any future harmonisation of member state frameworks.

Is Cannabis Legal in Poland?

Recreational: Illegal Medical: Legal

Recreational cannabis is illegal in Poland. Possession of even small amounts is technically a criminal offence, though prosecutors have discretion to discontinue proceedings for minor personal cases. Poland's enforcement approach has generally been stricter than many Western European counterparts.

Medical cannabis

Medical cannabis was legalised in Poland in 2017, and the market has grown substantially. Poland has become one of Central Europe's larger medical cannabis markets by patient volume, driven by specialist clinic growth. Access remains constrained by high costs, limited reimbursement, and prescribing complexity.

2026 update: Poland followed Germany's lead in tightening telemedicine prescribing rules for medical cannabis. Restrictions on digital prescribing platforms were introduced on 7 November 2024 following concerns about standards in the online clinic sector.

Five Policy Battles Defining
European Cannabis in 2026

The European cannabis regulatory landscape is evolving faster than at any point in its short legal history. These five developments will define the direction of the market in 2026 and beyond.

1. Telemedicine restrictions spreading across Europe

Germany and Poland have both moved to restrict digital prescribing platforms for medical cannabis. Similar measures are under consideration elsewhere, with significant implications for the online clinic business model and patient access routes across the continent.

2. France's permanent medical programme launches

France's transition from pilot to permanent medical cannabis framework on 1 April 2026 is the continent's biggest single market-opening event. Reimbursement policy will determine how large the patient population becomes — and how quickly. Full analysis →

3. Czech Republic advancing adult-use legalisation

Czech legalisation legislation is progressing through parliament, with the potential to create the EU's second regulated adult-use market alongside Germany — a significant moment for Central European cannabis commerce.

4. Hemp and cannabinoid regulation tightening

Semi-synthetic cannabinoids (HHC, HHCP) have been banned in 22+ European countries. Novel food pathways for CBD remain inconsistent across member states. THC threshold debates in hemp continue to divide legislators and constrain the market.

5. Price compression and M&A reshaping the supply chain

German bulk flower prices have collapsed to €1–2/g for GACP product. Oversupply is forcing consolidation across the sector. The operators who navigate price compression will define European cannabis market structure for the decade ahead. Full analysis →
